If Trump posts a message that can cause the S&P 500 to surge 9% in a single day, how much is that message worth? Trump Media & Technology Group's answer: up to $100,000 per month. On August 1st, the Truth API officially launched. Target customers: Wall Street high-frequency trading firms. Service content: receive the content "a few milliseconds" faster than Trump's public posts. First batch of sign-ups: over 10 companies. Imagine this scene— Trump finishes typing a message on Truth Social and hits send. A few milliseconds later, 10 paying institutions have already received the full text, and algorithms start automatic trading. Seconds later, your phone notification finally pops up. You see the news and open your trading app. Too late. This is not a conspiracy theory; this is a fact happening right now. Research firm Fundstrat's analysis shows that during Trump's administration, the five best and worst trading days for the S&P 500 were all directly triggered by White House policy statements and Trump's social media posts. The most typical example: on April 9, 2025, Trump posted announcing a pause on tariff increases, and the S&P 500 surged 9% in a single day. What does 9% mean? It's the normal annual gain in a typical year. And it all started with a single post. Now that post has a clear price tag. On August 12, news agency The Intercept and the Freedom of the Press Foundation filed a lawsuit in the New York Federal Court to stop the Truth API. The plaintiffs' accusation is straightforward: "corrupt and unconstitutional." Their reasoning: The First Amendment guarantees the public equal access to government information—now it's being sold at a clear price. The Fifth Amendment prohibits unreasonable fees for government benefits—$100,000 a month, is that "unreasonable"? "A president selling priority access to policy information he creates for profit for his privately controlled company—this was unimaginable a few years ago." What is Trump's response? "Providing real-time public data through paid subscriptions is a common practice in the media industry." Hmm, equating presidential policy statements with Bloomberg Terminal market data. But what's truly chilling is something else. Trump Media & Technology Group lost $238 million in Q2. Truth Social's daily active users are only 260,000, down 40% year-over-year, not even a fraction of X's. This company is barely surviving. And the first 10 clients of Truth API are expected to generate $7 to $12 million annually—already 2 to 3 times the company's total revenue last year. In other words, Trump is using the president's "posting rights" to keep his dying company alive. And that's not all. Interim CEO McGahn said on the earnings call that the company is evaluating licensing data streams to prediction market operators. Translation: in the future, not only trading firms will see the president's posts before you, even casinos can use this to set odds. Democratic Senators Elizabeth Warren and Adam Schiff have written to the SEC, requesting an investigation into whether this service violates the law. Former White House chief ethics lawyer Paynte put it more harshly: "If I were an SEC commissioner, I would threaten to resign unless they stop this plan." But the problem is—Trump is the president. Who oversees the SEC? The president. Congress can investigate, but can it stop it? Difficult. Courts can rule, but what about appeals to the Supreme Court? The conservative-majority Supreme Court is 6 to 3. This is a lawsuit destined to be long and with an uncertain outcome. Finally, some hard truths— In the world of Truth API, retail investors don't even have an "information disadvantage." You have "information delay"—by the time you know what happened, the market has already moved. High-frequency trading firms pay $100,000 a month to buy a few milliseconds of time difference. And those few milliseconds could mean a 9% gain or the entire escape window of a crash. If this isn't insider trading, what is? Insider trading is defined as "trading based on non-public information." The president's policy statements, before public release, are non-public information. Selling this non-public information to paying clients—how is this different from insider trading? The only difference might be: the person doing it is the president. So, don't fool yourself. You think you're trading fundamentals, technicals, or sentiment— But in reality, you're trading on the scraps of "information asymmetry."
